Terms of Service

Article 1 (Scope of Application)

These Terms of Service (hereinafter "these Terms") set forth the conditions for use of the trade statistics data analysis platform "Kouro" (hereinafter "this Service") operated by Five Inc. (hereinafter "the Company").

All users of this Service (hereinafter "Users") shall use this Service in accordance with these Terms.

Article 2 (Registration)

1. Users who wish to use this Service shall agree to these Terms and register through the method prescribed by the Company.
2. The Company may refuse registration if it determines that any of the following reasons apply:
   • False information was provided during registration
   • The applicant has previously violated these Terms
   • The Company otherwise deems the registration inappropriate

Article 3 (Account Management)

1. Users shall manage their account information for this Service under their own responsibility.
2. Users may not transfer or lend their account to third parties under any circumstances.
3. The Company shall bear no responsibility for damages arising from unauthorized use of accounts.

Article 4 (Prohibited Activities)

Users shall not engage in any of the following activities when using this Service.

• Activities that violate laws or public order and morals
• Criminal activities
• Activities that infringe on intellectual property rights, portrait rights, privacy, or other rights of the Company, other users, or third parties
• Activities that cause economic damage to the Company, other users, or third parties
• Activities that destroy or interfere with the Company's servers or network functions
• Activities that may interfere with the operation of this Service
• Unauthorized access or attempts thereof
• Impersonating other users
• Sending or displaying information that the Company deems inappropriate
• Any other activities that the Company deems inappropriate

Article 5 (Service Suspension)

The Company may suspend or interrupt the provision of this Service without prior notice to Users if it determines that any of the following reasons apply:

• Maintenance or updating of this Service's systems
• Difficulty in providing this Service due to server failures or other technical issues
• Difficulty in providing this Service due to force majeure
• Any other reason the Company deems it difficult to provide this Service

Article 6 (Fees)

1. Users who use paid features of this Service shall pay the fees separately determined by the Company.
2. Fee details are listed on the pricing page (/pricing) of this Service.
3. Users who are late in paying fees shall pay late payment charges.

Article 7 (Intellectual Property)

All intellectual property rights in the content included in this Service (text, images, data, software, etc.) belong to the Company or third parties with legitimate rights.

Article 8 (Disclaimer)

1. The Company does not warrant that this Service is free from defects, either in fact or in law.
2. The Company bears no responsibility for any transactions, communications, or disputes between Users and other users or third parties regarding this Service.
3. The trade statistics data provided by this Service is based on data published by the Ministry of Finance, but we do not guarantee the accuracy or completeness of the data.

Article 9 (Service Changes)

The Company may change the content of this Service or discontinue its provision without prior notice to Users.

Article 10 (Changes to Terms)

The Company may change these Terms without obtaining individual consent from Users in the following cases.

• When the change to these Terms is in the general interest of Users
• When the change to these Terms does not conflict with the purpose of this Service, and the necessity and reasonableness of the change is sufficient

Article 11 (Withdrawal)

Users may withdraw at any time through the withdrawal procedures prescribed by the Company. No refunds will be made for unused periods after withdrawal.

Article 12 (Governing Law and Jurisdiction)

1. These Terms shall be governed by and interpreted under the laws of Japan.
2. In the event of any dispute regarding this Service, the court having jurisdiction over the location of the Company's head office shall be the exclusive agreed-upon court of jurisdiction.
